Case Review
The first step in any appeal is to review everything that has happened in the case. This means obtaining and reviewing the court record, transcripts, and prior counsel's file. In some cases, it also includes obtaining and reviewing prison records and documents from any co-defendants' cases. Once the case is reviewed, the attorney meets with the client, and together they determine the best course of action. Depending on the type of case, this includes not only identifying the issues for appeal, their chances of success, and the possible risks of raising a particular challenge, but also what type of motion to file in what court. A case review can also be done to provide a second opinion about both the trial proceedings and any prior appellate proceedings.
