Sentence Adjustment
The Wisconsin legislature enacted Wis. Stat. §973.195 to address the prison overcrowding problem created by the enactment of Truth in Sentencing. The statute allows a defendant to petition for the reduction of the prison portion of the sentence after successful completion of 75 or 85 percent, depending on the crime, of the prison portion (initial confinement) of the sentence. The court considers factors including conduct in prison, treatment, and programming received while in prison in determining whether to grant a petition for sentence adjustment.
